the only problem with this ad placement would be of course that you don't control what is written just above the ad, so sometimes could be seen an inciting on clicking on the ads or labelling the ads. But I guess in the end it will be up to the adsense worker to penalize or not, so if it works fine most of the time it's ok.

yes, maybe, but no need to solve a non existent problem, if a problem arises one day you'll be alerted by adsense about it. maybe they never contacted dp about it, could be the same for everyone.
